AFFORDABLE HOUSING OBLIGATIONS FOR 2025-2035 (FOURTH ROUND)

On 03/20/24,, Governor Murphy signed P.L.2024, c.2. into law, establishing a new framework for determining and enforcing municipalities’ affordable housing obligations under the New Jersey Supreme Court’s Mount Laurel doctrine and the State’s Fair Housing Act. The law required that the Department of Community Affairs (DCA) perform a calculation of regional need and municipal present and prospective obligations in accordance with the formulas established in the law. On 10/20/24, the DCA issued their report outlining the fourth round (2025-2035) fair share methodology and calculations of low- and moderate-income housing obligations for New Jersey’s 564 municipalities.

The DCA calculation of the municipal present need and the municipal prospective need are based on established datasets and an established methodology. The Borough has been advised of the DCA's determination for New Milford and is reviewing it with the Borough Planner. The Borough and the Planner have been anticipating this report and have prepared a Vacant Land Adjustment and Calculation of Realistic Development Potential. Based on preliminary analysis, New Milford has a relatively modest RDP. The largest privately owned parcel for development or redevelopment has already been identified and zoned for inclusionary housing. The Borough has until 01/31/25, to formally respond to the DCA number and until June 30,2025 to adopt a new Housing Element and Fair Share Plan.
